Terms of Service

1. Introduction & Acceptance

Frippy ("we", "us", "our") is a peer-to-peer marketplace for secondhand fashion, operated by Frippy AU (ABN 51 847 511 301) in Perth, Western Australia. Frippy is available as a mobile application and at frippy.au (together, the "Platform").

By creating an account or using the Platform, you agree to these Terms of Service ("Terms"). If you do not agree, do not use Frippy.

We may update these Terms from time to time. If we make material changes, we will notify you through the Platform. Continued use after changes take effect constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old to use Frippy. By creating an account, you confirm that you are 18 or older and are capable of entering into a legally binding agreement under Australian law.

You may only hold one account. Accounts are personal and may not be transferred or shared.

3. Frippy's Role

Frippy is a platform that connects buyers and sellers. We are not a party to the transactions between users. We do not own, inspect, or take possession of any items listed on the Platform.

While we provide tools such as buyer protection, moderation, and dispute resolution, the sale contract is between the buyer and the seller. Payments are processed and held by our payment provider, Stripe, and released to the seller once delivery is confirmed in accordance with our Buyer Protection Policy.

4. Fees

Frippy does not charge sellers any fees to list or sell items.

Buyers pay a Buyer Protection Fee on each purchase, calculated as $0.99 AUD + 5.5% of the item price. This fee covers access to our Buyer Protection service, including secure payment processing, dispute resolution, and refund support.

Buyers also pay the shipping cost for each order. Shipping rates are calculated at checkout based on the item's estimated weight and dimensions, and the delivery destination.

When purchasing multiple items from the same seller as a bundle, shipping costs are combined and may be reduced. Any bundle discount offered by the seller applies to the item prices before the Buyer Protection Fee is calculated.

5. Payments & Payouts

All payments are processed by Stripe. By purchasing an item, you authorise Stripe to charge your selected payment method for the item price, Buyer Protection Fee, and shipping cost.

Sellers receive their payout after the buyer confirms delivery, or automatically after a confirmation period if the buyer does not raise a dispute. Payouts are made to the seller's verified Stripe account.

To receive payouts, sellers must complete identity verification through Stripe. Frippy does not store or have access to your bank account details or card numbers — these are handled directly by Stripe.

6. Buyer Protection

Frippy's Buyer Protection applies to every purchase made through the Platform. If you receive an item that is significantly not as described, damaged, or if the item does not arrive, you may open a dispute within 72 hours of delivery confirmation.

If your dispute is resolved in your favour, you will receive a full or partial refund. Depending on the circumstances, you may be required to return the item using a prepaid shipping label provided through the Platform.

Buyer Protection does not cover change of mind, minor differences from listing photos (such as slight colour variations), or items accurately described by the seller. If you change your mind about a purchase, you may contact the seller to arrange a return. Any such arrangement is between the buyer and seller, and Frippy is not obligated to facilitate it. Return shipping costs in this case are the buyer's responsibility.

7. Listings & Seller Responsibilities

By listing an item on Frippy, you represent that you are the lawful owner of the item and have the right to sell it. You are responsible for providing accurate descriptions, photos, sizing, condition, and pricing.

Sellers must ship items within the timeframe indicated at checkout. Failure to ship on time may result in automatic cancellation and refund to the buyer.

Sellers are responsible for packaging items securely to prevent damage during transit. Frippy is not liable for items damaged due to inadequate packaging.

8. Prohibited Items & Content

The following items may not be listed on Frippy: counterfeit or replica goods, stolen property, items that are illegal to sell in Australia, weapons, hazardous materials, drugs or drug paraphernalia, animals, food or consumables, used underwear, and any items outside the categories available on the Platform.

Users must not post content that contains hate speech, threats, harassment, sexually explicit material, personal contact information intended to circumvent the Platform, or any content that violates applicable Australian law.

Frippy reserves the right to remove any listing or content that violates these Terms without prior notice.

9. Moderation & Enforcement

Frippy uses a combination of automated systems and manual review to moderate listings and messages. Content that violates these Terms may be removed or restricted.

We may, at our sole discretion, issue warnings, restrict features, suspend, or permanently ban accounts that breach these Terms. Repeated violations or severe breaches (such as listing counterfeit goods or engaging in fraud) may result in immediate account termination.

Moderation decisions are made in good faith to maintain a safe marketplace. While we strive to be fair, moderation decisions are final.

10. Disputes

If a buyer is unsatisfied with a purchase, we encourage both parties to communicate through the in-app chat to resolve the issue directly.

If no resolution is reached, the buyer may open a formal dispute within 72 hours of delivery confirmation. The seller will have the opportunity to respond. If the parties cannot agree, Frippy will review the evidence provided by both sides and make a decision.

Frippy's dispute resolution is provided as a service to facilitate fair outcomes between users. Dispute decisions are made at our discretion and are final. Nothing in these Terms limits your rights under the Australian Consumer Law.

11. Shipping & Delivery

All transactions on Frippy are shipping-only. Local pickup is not available. This is to ensure the safety of all users and to enable payment protection and delivery tracking on every transaction.

Shipping labels are generated through the Platform using our logistics partners. Sellers must use the provided shipping label and drop off the parcel at the designated carrier location.

While Frippy does not control the shipping carrier's operations and cannot guarantee delivery timeframes, buyers are covered under our Buyer Protection policy if an item arrives damaged or does not arrive at all.

Delivery is considered confirmed when the buyer confirms receipt through the Platform, or automatically after a set period if no dispute is raised.

12. Intellectual Property

All content on the Platform — including the Frippy name, logo, design, and software — is owned by or licensed to Frippy and is protected by Australian and international intellectual property laws.

By posting photos, descriptions, or other content on Frippy, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content on the Platform and in connection with promoting Frippy. You retain ownership of your content and may remove it by deleting your listing or account.

13. Limitation of Liability

To the maximum extent permitted by Australian law, Frippy is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. This includes, but is not limited to, loss of profits, data, or business opportunities.

Frippy does not guarantee that the Platform will be available at all times or free from errors. We are not liable for any losses resulting from service interruptions.

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded by law.

14. Account Termination

You may delete your account at any time through the app settings. Account deletion is permanent and cannot be reversed.

We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or use the Platform in a way that harms other users or Frippy's reputation.

If your account is terminated while you have pending transactions, we will make reasonable efforts to complete or cancel those transactions and process any refunds owed.

15. Governing Law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Western Australia.
